    This privacy statement informs you about how and which data we collect on our company websites, for which purpose they are used and by whom they are processed. Furthermore, it will give you an overview of your options and rights in context with personal data.

    You can refuse or revoke your consent to the gathering, usage, and transfer of your data at any time via the cookie settings.

    Gathering, Usage and Procession of Data

    To enable technical operation, all IPCOMM websites automatically collect the information transmitted by your provider as default. In addition to IP addresses and time stamps of accesses, language, type, and configuration of the web browser, also page references within the IPCOMM web pages are included. These are temporarily stored in a so-called log file until they are automatically deleted.
    This data is evaluated for statistical purposes in a way that IPCOMM cannot draw any conclusions about your person. For this purpose, corresponding characteristics and IP addresses, which can be used to identify you, are removed during evaluations. The anonymized information is analyzed and used as a whole in order to improve the services on our website and to identify usage patterns.

    Furthermore, IPCOMM processes the above-mentioned data for the following purposes:

    • Optimization of the website's user-friendliness
    • Evaluation of system security and stability
    • For administrative purposes

    In addition, personal data such as names, addresses, telephone numbers or e-mail addresses are only gathered within the scope of website operation if you expressly provide them voluntarily and if we are authorized to use or process them on the principle of legal regulations (e.g., contact requests). This applies in particular with your consent.
    IPCOMM will only maintain personal data for the period of time necessary to fulfil the above-mentioned purposes and to fulfill legal obligations. This data is used solely for the stated purpose, such as answering your contact requests or processing your orders.

    Newsletter Subscription

    Insofar as you have explicitly consented in pursuance of Art. 6 sec. 1 letter a) GDPR, IPCOMM will use your e-mail address to regularly send you a newsletter. For receiving the newsletter, an email address is sufficient.

    A link at the end of a newsletter will give you the opportunity to unsubscribe from the newsletter at any time. Alternatively, you can send your unsubscription request at any time by e-mail to info@ipcomm.de.

    Establishing Contact

    If you contact us, we will store your details for processing your inquiry and in the event that subsequent questions arise. IPCOMM stores and uses further personal data only with your consent, or if it is legally permissible without special consent.

    Data processing for the purpose of contacting IPCOMM is carried out in accordance with Art. 6 sec. 1 letter a) GDPR based on your voluntary consent.

    Product Configurator

    When using the product configurator, we offer you the opportunity to request qualified offers for specific products using a particular form. From a technical point of view, the following information is required:

    • Name
    • E-mail address
    • Company
    • Company address

    Further information can be optionally given.
    This data processing is legally based on the necessity of handling pre-contractual measures with you in accordance with Art. 6 sec. 1 letter b) GDPR.

    Application process

    IPCOMM gathers and processes personal data in the context of the application procedure for the purpose of employment according to §26 FDPA in conjunction with Art. 88 sec. 1 GDPR.
    If an employment contract is concluded during the application process, your personal data may be processed and stored by IPCOMM for planning and organization purposes in compliance with legal requirements.
    If the application procedure has not been successful, IPCOMM will erase the transmitted personal data after a period of six months from the notification of the rejection, unless this conflicts with the obligation to provide evidence under the General Equal Treatment Act (GETA) or other legal provisions. The legal foundations for this are §24 sec. 1 number 2) FDPA and Art. 6 sec. 1 letter f) GDPR. Our legitimate interest is based on the establishment, exercise or defense of legal claims.
    The storage and processing of your data beyond this period will only take place with your explicit consent in accordance with Art. 6 sec. 1 letter a) GDPR. At any time, you have the right to withdraw your consent for future processing in accordance with Art. 7 sec. 3 GDPR.

    Legal Foundations and Storage Period

    Unless otherwise stated, the legal foundation for data processing is Art. 6 sec. 1 letter f) GDPR. Our legitimate interest follows from the above-mentioned purposes for data gathering. Under no circumstances will this data be collected for the purpose of drawing conclusions about you personally.
    Unless specifically stated, IPCOMM only stores personal data for as long as it is necessary to fulfil the purposes pursued.

    Disclosure of Data

    Your personal data will not be transmitted to third parties for purposes other than listed below.

    IPCOMM will only disclose your personal data to third parties if:

    • you have given your explicit consent in accordance with Art. 6 sec. 1 letter a) GDPR
    • the disclosure in accordance with Art. 6 sec. 1 letter f) GDPR is necessary for the establishment, exercise or defense of legal claims, and there is no reason to assume that there is an overriding protection interest in the non-disclosure of your data
    • there is a legal obligation for the disclosure pursuant to Art. 6 sec. 1 letter c) GDPR
    • it is legally permissible and is required for the processing of contractual relationships with you by Art. 6 sec. 1 letter b) GDPR

    Personal data stored by us will not be sold to third parties. However, it may be necessary to disclose personal data to IPCOMM service providers for business purposes. Service providers contracted by IPCOMM only receive the information that is necessary for the fulfilment of the respective service. In the process, the service providers are obliged by IPCOMM to comply with the applicable data protection regulations.

    In the event of IPCOMM outsources certain steps of data processing ('contracted data processing'), IPCOMM contractually obliges processors to use personal data only in accordance with the requirements of the data protection regulations and to ensure the protection of the rights of the data subject.

    Cookies and Local Storage

    When you visit the websites, IPCOMM collects information using various technologies, in particular cookies and 'HTML5 Local Storage'. A cookie is a small text file that is sent from the website to your browser in order to place it on your computer. 'Local Storage' is a technology that your browser uses to store data on your device.

    In the interests of maintaining essential functions and ensuring website operation, IPCOMM uses 'necessary cookies' and the 'Local Storage', which do not contain any personal information. Neither 'technical cookies' nor the 'Local Storage' are merged with personal data provided by you.

    IPCOMM also uses 'tracking cookies' - with your explicit consent - which serve to improve the range of services and optimize the website. For example, required form fields can be automatically completed with personal data already transmitted. You can set the website to store tracking cookies by adjusting its settings accordingly. Please note, however if you decide against saving, there may be functional limitations.

    The data processed by cookies and 'Local Storage' is required for the above-mentioned purposes in order to safeguard the legitimate interests and those of third parties pursuant to Art. 6 sec. 1 letter f) GDPR.

    User Profiles

    For designing and optimizing purposes, IPCOMM may create pseudonymous user profiles, collect pseudonymized user data and store them in an aggregated way. In this context, IPCOMM uses the following tracking and analysis technologies provided by third parties. These use cookies.

    If you have consented, the above-mentioned information is used by third parties on behalf of IPCOMM to provide anonymous usage evaluations on the websites and to provide IPCOMM with services related to the usage of the website. The data about your visit is used to understand how users generally behave on the websites, to present interesting content and to improve our services.

    The measures employed are based on the safeguarding of the legitimate interests pursuant to Art. 6 sec. 1 letter f) GDPR, and serve the purposes listed above.

    The following technologies are provided with the IP addresses transmitted by your web browser. These will not be merged with other data of subsequent third parties.

    Cookie Consent Manager CCM19

    On our websites, we use 'Cookie Consent Manager CCM19' to store information about which cookies may be set. This service is provided by Papoo Software & Media GmbH, Augustenstr. 4, 53229 Bonn, Germany.

    To store your cookie preferences, the service creates a record in your 'Local Storage' so that these can be taken into account for subsequent page views. The data is stored sorted by category. From a technical point of view, Papoo Software & Media GmbH can use your IP address to determine from which website the request was sent. The legal foundation for the transmission of your cookie preferences is our obligation to prove your consent to the processing of personal data pursuant to Art. 7 sec. 1 GDPR.

    Google Analytics

    Our web pages contain Google Analytics, a web analysis service provided by Google Ireland Ltd. ('Google'), Gordon House, Barrow Street, Dublin 4, Ireland.
    In the process, pseudonymized user profiles are created and cookies are used for the purpose of demand-oriented design and continuous optimization of our pages, and to analyse the success of our marketing campaigns. The access data is collected anonymously so that no reference can be made to you as a user. This is done by anonymizing your IP address.

    During your website visit, your user behavior is recorded in the form of "events", such as

    • Page views
    • First visit to the website
    • Start of session
    • Click paths (interactions with the website)
    • Scrolls (whenever a user scrolls to the bottom of the page (90%))
    • Clicks on external links
    • Interaction with videos
    • File downloads
    • Viewed / clicked ads
    • Language settings

    Further, information is collected such as

    • Your approximate location (region)
    • IP address (in shortened form)
    • Technical information about your browser and the end devices you use (e.g. language setting, screen resolution)
    • Internet service provider
    • Referrer URL (the previously visited page)

    and transmitted to a Google server, where it is processed and stored. The information is used on our behalf to analyze the usage of the website, to create reports, and to provide other services related to the use of the website and the Internet for market research purposes. Furthermore, they are used for the demand-oriented design of these Internet pages.
    Under certain circumstances, the data may be transferred to third parties if this is required by law or if third parties process the data on our behalf.

    Please note that Google can also transfer personal data to third countries outside of the European Economic Area which are not covered by an adequacy decision of the European Commission. In such cases Google will use the standard contractual clauses approved by the European Commission, which constitute an appropriate safeguard, within the meaning of Art. 46 sec. 2 letter c) GDPR for transfers to third countries.

    In the context of the use of the web analytics service Google Analytics, the extension Google Signals, a web analytics service provided by Google Ireland Ltd ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland, is used.

    The extension is used for cross-device tracking of usage data. If you have enabled "personalized advertising" in your Google account settings and your end devices are linked to your Google account, Google can analyze your usage behavior on our website across devices. Google Signals provide us with additional reports on cross-device usage data and user groups, useful information about our visitors' interests and demographics, and more detailed advertising reports. This includes the age of the users, which language they speak, where they live, and which gender they belong to. Social criteria such as occupation, marital status or income are also considered. All these characteristics help Google Analytics to define groups of people or target groups. These anonymized, statistical reports do not allow us to infer your identity. The data collected through Google Signals is valid for 26 months by default.

    Google itself may collect personal data in the process. You can find more information on this in Google's privacy policy.

    You can object to the collection by Google Signals at any time by deactivating "personalized advertising" in your Google account.

    The use of the analysis service is based on your consent (Art. 6 sec. 1 letter a, GDPR). You can withdraw your consent at any time via the cookie settings.

    Google Ads Conversion-Tracking

    Our web pages use Google Ads, an online advertising program, and Google Ads' conversion tracking, an analysis service. Both are maintained by Google Ireland Ltd. ('Google'), Gordon House, Barrow Street, Dublin 4, Ireland.
    When you click on an ad placed by Google, a conversion tracking cookie is set which has a lifetime of 30 days and does not contain any personal information. This cookie is used to track whether you have come to our website through an ad within this period. Since all Google Ads customers set their own cookie, they cannot identify you on their websites using this cookie. Information obtained through conversion tracking is used to create conversion statistics. This gives IPCOMM the total number of users who clicked on an ad and were forwarded to a page with a conversion tracking tag.

    Please note that Google can also transfer personal data to third countries outside of the European Economic Area which are not covered by an adequacy decision of the European Commission. In such cases Google will use the standard contractual clauses approved by the European Commission, which constitute an appropriate safeguard, within the meaning of Art. 46 sec. 2 letter c) GDPR for transfers to third countries.

    The use of the advertising service is based on your consent (Art. 6 sec. 1 letter a, GDPR). You can withdraw your consent at any time via the cookie settings. You can also opt-out of Google Ads conversion tracking by disabling your web browser's cookie feature. As a result, your data will not be included in the conversion tracking statistics.

    Google Ads Personalization

    To advertise our websites, we use personalized Google Ads campaigns, a web-based advertising service provided by Google Ireland Ltd. ('Google'), Gordon House, Barrow Street, Dublin 4, Ireland.

    We use this technology to serve you interest-based ads on Google advertising network websites and to target Google Ads campaigns to advertising audiences (e.g., 'affinity audiences', 'in-market audiences'). Additionally, the use of device identifiers can be managed through your device's settings.

    Google Maps

    Our websites use Google Maps, a web-based map service, which is provided by Google Ireland Ltd. ('Google'), Gordon House, Barrow Street, Dublin 4, Ireland.
    When you visit a website that contains a Google map, Google will set a cookie if you have consented to this. To display the location of IPCOMM, your data transmitted by the browser is processed. From a technical point of view, Google can use your IP address to determine from which website the request was sent.

    Matomo

    Our web pages use Matomo (formerly Piwik), a web analysis service provided by Innocraft Ltd., 150 Willis St, 6011 Wellington, New Zealand. In this context, cookies are used. The cookie generates information about the usage of the website, such as

    The use of the analysis service is based on our legitimate interest (Art. 6 sec. 1 letter f, GDPR) in the anonymized analysis of user behavior to optimize both the web services and our advertising.

    Rights of Persons Concerned

    According to the applicable laws, there are various rights regarding your personal data. If you wish to avail yourself of these rights, please send your request by letter or e-mail to the above-mentioned responsible body, clearly identifying yourself.

    The following is an outline of your rights:

    Right to Confirmation and information

    According to Art. 15 GDPR, you have the right to request information about your personal data processed and stored by IPCOMM free of charge at any time. In addition, there is a right to the following information:

    • the purposes of the processing
    • categories of personal data concerned
    • the recipients or categories of recipient to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organizations
    • appropriate safeguards pursuant to Article 46 GDPR, where personal data are transferred to a third country or to an international organization
    • the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period
    • the existence of the right to request from the controller rectification or erasure of personal data or restriction of processing of personal data or to object to such processing
    • the right to lodge a complaint with a supervisory authority
    • where the personal data are not collected from IPCOMM any available information as to their source
    • the existence of automated decision-making, including profiling, referred to in Article 22 sec. 1 and 4 GDPR and, at least in those cases, meaningful information about its details
    Right to rectification

    In accordance with Art. 16 GDPR, you have the right to immediately request the rectification or completion of your personal data stored by IPCOMM.

    Right to erasure ('right to be forgotten')

    According to Art. 17 GDPR, you have the right to request the deletion of your personal data stored at IPCOMM, unless the processing is

    • necessary for the exercise of freedom of expression and information
    • necessary for the fulfilment of legal obligations
    • justified by the public interest
    • necessary for establishment, exercise or defense of legal claims
    Right to restriction of processing

    Pursuant to Art. 18 GDPR, you have the right to request that the processing of your personal data be restricted, as far as one of the following conditions is fulfilled:

    • the accuracy of personal data is contested by you
    • the processing is unlawful, you oppose the erasure of your data
    • IPCOMM no longer needs the personal data for processing purposes, but you do need the data to establish, exercise or defend legal claims, or
    • You have filed an objection against the processing of your personal data pursuant to Art. 21 GDPR
    Right to data portability

    In accordance with Art. 20 GDPR, you have the right to receive your personal data in a structured, commonly used and machine-readable format or to request direct transmission to another responsible party.

    Right to withdraw consent

    In pursuance of Art. 7 sec. 3 GDPR, you have the right to withdraw your consent to the processing of personal data at any time.

    Automated individual decision-making, including profiling

    According to Article 22 GDPR, you have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effect against you or significantly affects you in a similar manner.

    Right to lodge a complaint with a supervisory authority

    In accordance with Article 77 GDPR, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, your workplace or the place of the alleged infringement, if you consider that the processing of personal data concerning you is unlawful.

    Right to Object

    Pursuant to Article 21 GDPR, you have the right to object to the processing of personal data concerning you on the ground of Article 6 sec. 1 letter f) for reasons arising from your particular situation at any time; this also applies to profiling based on these provisions. If the objection is directed against the processing for direct advertising, it will be realized by IPCOMM without stating a specific situation.

    Data Protection

    IPCOMM is committed to ensuring the security of your data within the framework of applicable data protection regulations and technical possibilities.
    IPCOMM uses the SSL (Secure Socket Layer) encryption method for the transmission of your personal data on the websites. This applies in particular to the use of the contact form. You can recognize an encrypted Internet page by the closed lock symbol in the status bar of most browsers. At this time, we would like to point out that transmission on the Internet can have security vulnerabilities (e.g. when communicating by e-mail). Therefore, a complete protection of the data against access by third parties is impossible.
    In addition, IPCOMM takes appropriate technical and organizational security measures to secure your data, which are kept up to date in line with technological developments.
